BREAKING: Massive Government Surveillance Program Exposed, All Americans Affected

ast night’s NSA scoop by the UK Guardian?  Child’s play.  The Washington Posthas published a truly shocking story exposing the largest government domestic program in American history.  If you are reading this right now, you have been affected by PRISM, a top secret operation begun in 2007 that has expanded “exponentially” during the Obama administration.  This isn’t the plot of a futuristic thriller.  This is the US government at work, here and now:

The National Security Agency and the FBI are tapping directly into the central servers of nine leading U.S. Internet companies, extracting audio, video, photographs, e-mails, documents and connection logs that enable analysts to track a person’s movements and contacts over time. The highly classified program, code-named PRISM, has not been disclosed publicly before. Its establishment in 2007 and six years of exponential growth took place beneath the surface of a roiling debate over the boundaries of surveillance and privacy. Even late last year, when critics of the foreign intelligence statute argued for changes, the only members of Congress who knew about PRISM were bound by oaths of office to hold their tongues…The technology companies, which participate knowingly in PRISM operations, include most of the dominant global players of Silicon Valley. They are listed on a roster that bears their logos in order of entry into the program: “Microsoft, Yahoo, Google, Facebook, PalTalk, AOL, Skype, YouTube, Apple.” PalTalk, although much smaller, has hosted significant traffic during the Arab Spring and in the ongoing Syrian civil war. Dropbox , the cloud storage and synchronization service, is described as “coming soon.” Government officials declined to comment for this article.

The Post describes the current program as President Bush’s warrantless wiretapping program on powerful steroids, with Bush’s successor — who wasfiercely critical of that effort — presiding over PRISM’s vast expansion:

The Silicon Valley operation works alongside a parallel program, code-named BLARNEY, that gathers up “metadata” — address packets, device signatures and the like — as it streams past choke points along the backbone of the Internet. BLARNEY’s top-secret program summary, set down alongside a cartoon insignia of a shamrock and a leprechaun hat, describes it as “an ongoing collection program that leverages IC [intelligence community] and commercial partnerships to gain access and exploit foreign intelligence obtained from global networks.”  But the PRISM program appears more nearly to resemble the most controversial of the warrantless surveillance orders issued by President George W. Bush after the al-Qaeda attacks of Sept. 11, 2001. Its history, in which President Obama presided over “exponential growth” in a program that candidate Obama criticized, shows how fundamentally surveillance law and practice have shifted away from individual suspicion in favor of systematic, mass collection techniques. The PRISM program is not a dragnet, exactly. From inside a company’s data stream the NSA is capable of pulling out anything it likes, but under current rules the agency does not try to collect it all.

Beyond providing the government with the ability to “pull out whatever it likes,” how potent is PRISM?

Even when the system works just as advertised, with no American singled out for targeting, the NSA routinely collects a great deal of American content…Firsthand experience with these systems, and horror at their capabilities, is what drove a career intelligence officer to provide PowerPoint slides about PRISM and supporting materials to The Washington Post in order to expose what he believes to be a gross intrusion on privacy. “They quite literally can watch your ideas form as you type,” the officer said.

That quote is chilling.  Let me stipulate this: Our intelligence agencies face an extraordinarily difficult and stressful task each and every day. They are responsible for the safety of 300 million people.  One mistake can costs lives.  I appreciate their efforts and understand that measures must be employed that are both totally secret, and at times unpleasant.  But where must we draw a line?  President Obama just gave a major speech about “balancing” the government’s national security obligations with protecting citizens’ rights and civil liberties.  He was very outspoken about this as a Senator and candidate, routinelyupbraiding the Bush administration for what he deemed to be excesses and abuses.  And yet here we are.  The Post’s thermonuclear bombshell notes that PRISM accounts for one out of every seven intelligence reports President Obama receives in his daily briefings.  One of the defenses we’ve heard of the NSA/Verizon phone records tracking program is that it only logs “meta-data,” or patterns, but does not monitor actual content.  Not so with PRISM:

This morning, I expressed doubts that the NSA operation was limited to Verizon customers.  Sure enough, it was not — not by a long shot:

In light of this information, how can one possibly interpret what you’re about to see as anything but a lie from President Obama’s DNI, James Clapper?  Sen. Ron Wyden (D-OR) asked Clapper in March if the NSA was collecting any type data on millions of Americans.  Clapper’s reply (the relevant Q&A starts at the 6:10 mark):

I don’t know what to say.  There are obvious jokes to be made about Democrats’ moronic “Republican overreach” talking point bursting into flames, or how the president will read about this in tomorrow’s newspaper like the rest of us.  But this feels too serious — too downright creepy and unsettling — to joke about at the moment.  The principles and rights at stake speak for themselves.  Perhaps the current government isn’t misusing these immense and expanding powers.  I hope that’s the case.  But in light of the IRS abuse and revelations of spying on journalists, what are citizens to believe?  What is acceptable to keep the country safe, and what is an existential threat to our liberty?  Also, the fact that we’re even learning about any of this constitutes an historic national security breach.  Are the leakers’ motives pure (ie, authentic whistleblowers), or is something else at play?

Go back and read the president’s recent national security speech at NDU, and hiscommencement address at Ohio State exhorting graduates to “reject” the cynical voices who warn of government tyranny.  What timing.  What a month.

UPDATE – Some of the internet companies are denying knowledge of PRISM, but aren’t commenting much further.  Some people are getting a little skeptical:

UPDATE II – NBC confirms PRISM’s existence with two sources, but they claim the program is a data collection operation, not a data mining one.  How does that make any sense?   Allahpundit asks, “They’re collecting the data but they’re not mining it?”  Another source tells USA Today that “no US citizens” are “targeted” under PRISM.  Hmm…

UPDATE III – A senior administration official tells Politico that PRISM only “targets” foreigners.  National Journal’s Ron Fournier isn’t impressed with this clarification.  The original WaPo story quoted a source familiar with the program who said that even when PRISM is working perfectly, it collects “a great deal” of American content.

UPDATE IV – DNI Clapper blasts the disclosures as “reprehensible” and harmful to national security.  He says both the Washington Post and Guardian stories contain “numerous inaccuracies,” stating that PRISM cannot be “intentionally used” to target anyone inside the US.

For out-of-towners seeking “four-star’’ accommodations here, there’s The Waldorf, The Pierre, The Plaza — and the city’s homeless shelters.

“People pay $3,000 for an apartment here, and I get to live here for free!” said Michal Jablonowski, 25, who moved back to the city from his native Poland three years ago and is now staying in a Bowery shelter.

“I have food. I have health care. It’s great,’’ Jablonowski said. “Here, the city supports you. The city helps you with everything.’’

City shelters boasting generous resources have increasingly become havens for out-of-towners, statistics show.

Nearly one in four of the city’s single homeless people who entered the system in December 2012 listed their last address as outside the city.

“We get breakfast, lunch and dinner. We have a microwave and TV. They do the laundry for free,” noted Jablonowski, who lived in New York for years before going back to his homeland, only to return here to a freebie life.

Jablonowski said he even gets a prepaid cellphone — allowing 1,000 texts and 300 minutes a month — through Medicaid and boasted, “I’m going to get my teeth fixed.”

“I love New York because you cannot starve in New York, you can always find food and clothes,” he said.

“The shelters are really nice. You have clean sheets. You get to watch TV and stay in the warm. Homeless people have it so good, they don’t want to look for a job.’’

Last month, Mayor Bloomberg blasted the 30-year-old city decree that gives free shelter to anyone who says they need it.

“You can arrive in your private jet at Kennedy Airport, take a private limousine and go straight to the shelter system, walk in the door and we’ve got to give you shelter,” the mayor fumed.

Taxpayers shell out $3,000 a month to feed, house and provide other services to each homeless person. The average stay in a city shelter is as long as nine months — although there’s no limit.

“Some people in here have it better than people working 9 to 5, because they’re not paying rent. I’ve stayed in hostels worse. I call this four stars,” said William Sullivan, who came to the city from LA for a job that fell through.

“Everyone in this place has a silver spoon in their mouth. You get fed three to four meals a day, and the food here is great.”

A Michigan woman who arrived in December said she was drawn to New York for the “adventure.”

“New York is New York! That’s why people come here,” said Amy Kaufman, 41, who is staying in a city-funded Chelsea shelter.

“I go to the library, and I go sightseeing a lot in Times Square and Chelsea. I like it here.

“I’m staying here for a while because the housing options are better. Michigan is in a recession right now.”

Even reverse snowbirds from Florida would rather suffer through a brutal New York winter than be homeless in their own state. Florida is the second-most popular last address for out-of-town homeless.

“Survival in Florida was a lot harder than here. There are a lot more resources here for homeless, especially in terms of housing and finding transitional housing,” said Steve Rios, 49, who came up from the Sunshine State.

“I left Florida because the environment of the shelters and rules weren’t as good. In Florida, they throw you out quick. There was a lot of drug use and addicts. It was bad,” he said.

Rios, who is staying at the BRC homeless shelter on West 25th Street, says they give him everything he needs.

“We get a cafeteria, a bed and clothing. My case worker is helping me prepare a package for housing,” he said.

There were 48,553 people in city shelters last week — including 9,923 single adults and roughly 10,000 families.

The Fatihah, the first sura of the Qur’an, contains this:

“Guide us in the straight path, the path of those whom Thou hast blessed, not of those against whom Thou art wrathful, nor of those who are astray.” (1:6-7)

The traditional Islamic understanding of this is that the “straight path” is Islam — cf. Islamic apologist John Esposito’s book Islam: The Straight Path. The path of those who have earned Allah’s anger are the Jews, and those who have gone astray are the Christians.

The classic Qur’anic commentator Ibn Kathir explains that “the two paths He described here are both misguided,” and that those “two paths are the paths of the Christians and Jews, a fact that the believer should beware of so that he avoids them. The path of the believers is knowledge of the truth and abiding by it. In comparison, the Jews abandoned practicing the religion, while the Christians lost the true knowledge. This is why ‘anger’ descended upon the Jews, while being described as ‘led astray’ is more appropriate of the Christians.”

Ibn Kathir’s understanding of this passage is not a lone “extremist” interpretation. In fact, most Muslim commentators believe that the Jews are those who have earned Allah’s wrath and the Christians are those who have gone astray. This is the view of Tabari, Zamakhshari, the Tafsir al-Jalalayn, the Tanwir al-Miqbas min Tafsir Ibn Abbas, and Ibn Arabi, as well as Ibn Kathir. One contrasting, but not majority view, is that of Nisaburi, who says that “those who have incurred Allah’s wrath are the people of negligence, and those who have gone astray are the people of immoderation.”

Wahhabis drew criticism a few years back for adding “such as the Jews” and “such as the Christians” into parenthetical glosses on this passage in Qur’ans printed in Saudi Arabia. Some Western commentators imagined that the Saudis originated this interpretation, and indeed the whole idea of Qur’anic hostility toward Jews and Christians. They found it inconceivable that Muslims all over the world would learn as a matter of course that the central prayer of their faith anathematizes Jews and Christians.

But unfortunately, this interpretation is venerable and mainstream in Islamic theology. The printing of the interpretation in parenthetical glosses into a translation would be unlikely to affect Muslim attitudes, since the Arabic text is always and everywhere normative in any case, and since so many mainstream commentaries contain the idea that the Jews and Christians are being criticized here. Seventeen times a day, by the pious. And in the Arizona State Senate, with the willing participation of the foolish kuffar.

Justice to Share Secret Drone Papers With U.S. Lawmakers

President Barack Obama has ordered the Justice Department to show lawmakers its classified legal justification for drone strikes against U.S. citizens abroad who are found to be terrorists.

Members of the House and Senate intelligence committees will be given access to the documents from the department’s Office of Legal Counsel, White House press secretary Jay Carney said. The move was made days after a Justice Department outline of circumstances in which American citizens could be targeted became public.

The Obama administration’s policy on strikes by unmanned aircraft, pursued with little oversight by Congress or the judiciary, has angered lawmakers who have pressed for its legal justification. Questions about the policy have emerged as a potential obstacle to Senate confirmation of John Brennan, Obama’s counterterrorism adviser and an architect of the drone policy, as the next director of the Central Intelligence Agency.

Carney said today that there has been “heightened interest” in the admnistration’s rationale and that Obama “wants Congress to be part of our efforts to build a durable, legal framework for our counterterrorism efforts.”

During a hearing today on his nomination before the Senate Select Committee on Intelligence, the 57-year-old Brennan will confront questions on the use of the remotely piloted planes.

Justice Document

Lawmakers and human-rights lawyers say the outline, a 16- page unclassified Justice Department white paper obtained by NBC News, doesn’t provide the transparency Obama promised when he pledged in May 2009 that whenever his administration couldn’t release information for national-security reasons, he would “insist that there is oversight of my actions — by Congress or by the courts.”

Members of the intelligence panels will be granted access to guidance from the Office of Legal Counsel as it related to the Justice Department white paper.

California Senator Dianne Feinstein, the Democratic chairman of the intelligence committee, said the panel would receive the classified documents today.

“I am pleased that the president has agreed to provide the Intelligence Committee with access to the OLC opinion regarding the use of lethal force in counterterrorism operations,” Feinstein said in a statement. “It is critical for the committee’s oversight function to fully understand the legal basis for all intelligence and counterterrorism operations.”

‘Defined Circumstances’

The document obtained by NBC News detailed circumstances under which the U.S. is said to be justified in ordering the killing of an American citizen in al-Qaeda or an affiliated terrorist group. The white paper was prepared for members of Congress, Carney said.

“In defined circumstances, a targeted killing of a U.S. citizen who has joined al-Qaeda or its associated forces would be lawful under U.S. and international law,” the memo says. Those circumstances include killing a U.S. citizen who is also an al-Qaeda leader actively engaged in “planning operations to kill Americans.”

Such killings are legal, the document said, if an “informed, high-level official of the U.S. government” determines the citizen poses an imminent threat of violent attack, if capture is “infeasible,” and if the operation can be carried out “in a manner consistent with applicable law-of- war principles.”

In 2011, a drone strike in Yemen killed Anwar al-Awlaki, an American who was a leader of al-Qaeda in the Arabian Peninsula.

More Strikes

During the past four years, the Obama administration conducted six times as many drone strikes in Pakistan, the country where the CIA has done most of its targeted killings, as President George W. Bush’s administration did in the previous four years, according to the London-based Bureau of Investigative Journalism. The nonprofit organization tracks drone strikes and civilian casualties.

Senators led by Ron Wyden, an Oregon Democrat, have pressed the administration to explain its basis for using lethal force against Americans abroad and renewed their request in a letter on Feb. 4. The senators implied that foot-dragging might hurt Brennan’s confirmation.

“The executive branch’s cooperation on this matter will help avoid an unnecessary confrontation that could affect the Senate’s consideration of nominees for national security positions,” they wrote.

Policy ‘Wise’

Carney has defended the policy on targeted killings abroad, including of Americans, as “legal,” “ethical” and “wise.” He said the counterterrorism efforts are designed to limit civilian casualties.

Amnesty International, the human-rights advocacy organization, said that releasing additional information to members of Congress doesn’t do enough to answer questions about the drone program’s legality and called on lawmakers to hold hearings with independent specialists who can review the administration’s rationale.

“Transparency is not the end goal,” Zeke Johnson, director of the organization’s security with human rights campaign, said in a statement. “Ending killing lists is. The president must ensure that the government’s use of lethal force fully complies with international law.”

Perverse Obamacare Bate Snares Arizona’s Governor

As D-Day looms for ObamaCare, one big question is how many states will sign up for its Medicaid expansion. The recent and spectacular flip-flop of Arizona Governor Jan Brewer is a case study in the political pressure and fiscal gimmicks designed to get states to succumb. It’s also a study in the arcane and perverse ObamaCare incentives that are intended to gather ever more health-care spending under federal control.

Arizona’s current Medicaid program is well run by the program’s standards—a low bar—but it is also too large. The program now finances one of every two in-state births and two of every three days seniors spend in nursing homes. Spending tripled in the last decade to $9 billion a year.

That’s despite $1.8 billion in cuts since 2009. The state fisc was such a mess that in 2010 Arizona Medicaid banned paying for several types of organ transplants. In March of that year, Ms. Brewer wrote to Mr. Obama calling the Affordable Care Act “a vast new entitlement program that our country does not have the resources to support” and also one that “makes our situation much worse, exacerbating our state’s fiscal woes by billions of dollars.”

Arizona argued before the Supreme Court that the Medicaid mandate was unconstitutional, anti-federalist commandeering—and seven Justices agreed it was “a gun to the head” and allowed states to opt out without penalty.

But so much for that. In her State of the State address last month, Ms. Brewer pulled a political 180°—or maybe 540°—and said expanding Medicaid would “inject $2 billion into our economy and “save and create thousands of jobs.” (Is Larry Summers moonlighting as a Brewer speechwriter?)

One secret of her switcheroo is Medicaid’s “matching rate” formula, in which the feds pick up 67% of Arizona’s existing spending and 100% (and later 90%) of the costs of ObamaCare’s newly eligible population. The state supposedly no longer needs to spend “billions” but merely an extra $154 million in 2014—then bank $1.6 billion from Washington, which her budget documents call “a return on investment of more than 10-to-1.”

How can the state conjure such money from nothing? The answer is that Ms. Brewer and Arizona hospitals have cooked up a spending scheme to rip off national taxpayers to avoid even the $154 million the state would at first pay. The hospital lobby first floated this scheme in 2011 “for the specific purpose of generating matching federal Medicaid funds.”

Here’s how it works: Arizona will tax hospitals and insurers for the $154 million. Then it will return $154 million to the health industry via more Medicaid business that will cover the cost of the tax and then some. The money needs to make a round trip from providers to the state and back to providers to game that 67% federal matching rate.

So Arizona takes (say) $3 from a hospital and then turns around and pays the $3 back, using one of the hospital’s own dollars that Arizona converted to “revenue” plus two dollars courtesy of Washington for its 67% federal share of the $3 payment. Arizona can then use the hospital’s remaining $2 of the original $3 to pay for another $6 of Medicaid expansion.

Some 49 state now use this trick of so-called provider taxes to goose federal spending, up from 21 in 2003. (Alaska is the exception.) But the practice is so abusive that even Mr. Obama proposed new limits in his last two budgets.

This subsidy honeypot can’t last forever, which is why other Governors are more skeptical about this Obama Medicaid windfall. When the money inevitably runs out, states will retain permanently larger obligations and lose budget autonomy for a generation or two as health care crowds out other priorities like education and roads.

Ms. Brewer was nonetheless besieged by health-industry lobbying, especially from hospitals that want more government money and the insurers that administer Medicaid. The campaign is orchestrated by Chuck Coughlin, Ms. Brewer’s former political strategist, and Peter Burns, a former Brewer budget consultant.

Providers are especially powerful at the state and local level, and the goal now is to rush the Brewer-Obama condominium through the Phoenix legislature with little debate. A particular offender is the Arizona Hospital and Healthcare Association, a trade group whose 2012 agenda includes “Oppose Taxpayer Bill of Rights-style legislative referendums or bills that arbitrarily limit state spending.”

Ms. Brewer’s other rationale is that everybody else is doing it, and that if Arizona opts out of a larger Medicaid then “Arizona’s tax dollars would simply be passed to another state.” Well, no, Washington would simply spend less money that it doesn’t have. In any event Arizona is already a net tax beneficiary—pulling down $1.19 from the feds for every dollar it sends to D.C., according to the Tax Foundation.

Ten other GOP Governors have rejected Mr. Obama’s Medicaid bribe, with another 20, Democrats and Republicans, undecided. Twenty are expanding, including Republicans Brian Sandoval of Nevada, Susana Martinez of New Mexico, Jack Dalrymple of North Dakota and even, on Monday, Ohio’s John Kasich. Thus does modern government create the carrots and sticks of ever-larger government.

U.S. reverses stance on treaty to regulate arms trade

WASHINGTON (Reuters) – The United States reversed policy on Wednesday and said it would back launching talks on a treaty to regulate arms sales as long as the talks operated by consensus, a stance critics said gave every nation a veto.

The decision, announced in a statement released by the U.S. State Department, overturns the position of former President George W. Bush’s administration, which had opposed such a treaty on the grounds that national controls were better.

U.S. Secretary of State Hillary Clinton said the United States would support the talks as long as the negotiating forum, the so-called Conference on the Arms Trade Treaty, “operates under the rules of consensus decision-making.”

“Consensus is needed to ensure the widest possible support for the Treaty and to avoid loopholes in the Treaty that can be exploited by those wishing to export arms irresponsibly,” Clinton said in a written statement.

While praising the Obama administration’s decision to overturn the Bush-era policy and to proceed with negotiations to regulate conventional arms sales, some groups criticized the U.S. insistence that decisions on the treaty be unanimous.

“The shift in position by the world’s biggest arms exporter is a major breakthrough in launching formal negotiations at the United Nations in order to prevent irresponsible arms transfers,” Amnesty International and Oxfam International said in a joint statement.

However, they said insisting that decisions on the treaty be made by consensus “could fatally weaken a final deal.”

“Governments must resist US demands to give any single state the power to veto the treaty as this could hold the process hostage during the course of negotiations. We call on all governments to reject such a veto clause,” said Oxfam International’s policy adviser Debbie Hillier.

The proposed legally binding treaty would tighten regulation of, and set international standards for, the import, export and transfer of conventional weapons.

Supporters say it would give worldwide coverage to close gaps in existing regional and national arms export control systems that allow weapons to pass onto the illicit market.

Nations would remain in charge of their arms export control arrangements but would be legally obliged to assess each export against criteria agreed under the treaty. Governments would have to authorize transfers in writing and in advance.

The main opponent of the treaty in the past was the U.S. Bush administration, which said national controls were better. Last year, the United States accounted for more than two-thirds of some $55.2 billion in global arms transfer deals.

Arms exporters China, Russia and Israel abstained last year in a U.N. vote on the issue.

The proposed treaty is opposed by conservative U.S. think tanks like the Heritage Foundation, which said last month that it would not restrict the access of “dictators and terrorists” to arms but would be used to reduce the ability of democracies such as Israel to defend their people.

The U.S. lobbying group the National Rifle Association has also opposed the treaty.

A resolution before the U.N. General Assembly is sponsored by seven nations including major arms exporter Britain. It calls for preparatory meetings in 2010 and 2011 for a conference to negotiate a treaty in 2012.

The following organizations have lent monetary, grassroots or some other type of direct support to anti-gun organizations. In many instances, these organizations lent their name in support of specific campaigns to pass anti-gun legislation such as the March 1995 HCI “Campaign to Protect Sane Gun Laws.” Many of these organizations were listed as “Campaign Partners,” for having pledged to fight any efforts to repeal the Brady Act and the Clinton “assault weapons” ban.

NRA’s Facebook Page Vanishes

Following the horrific elementary school shooting in Connecticut on Friday, the National Rifle Association has disappeared from Facebook.

As of Monday morning, the organization’s Facebook presence has vanished. Its Twitter feed was last updated on the morning of Dec. 14, prior to the shooting. Additionally, the organization’s official site at NRA.org has been silent on the mass shooting.

On the day before the shooting, the NRA thanked its supporters for helping the organization reach 1.7 million “likes” on Facebook. In the shooting’s aftermath, the NRA’s Facbook page became a destination for people to vent their frustrations with the gun lobby.

The Daily Dot reports that the NRA was inundated with negative comments on Friday and that the organization decided to “hide” its page. One person wrote, “More blood on NRA today.” Another wrote, “20 people are dead and most are children. When will you start to say it’s not the guns but the man?”

TechCrunch argues that the NRA hiding its Facebook page may be the sensible response. The heated debate from pro- and anti-gun Americans “could have reflected poorly on the NRA, or forced it to prematurely make a statement about the shooting,” TechCrunch wrote. People currently attempting to access the NRA’s Facebook page are redirected to their own Facebook pages.

Thus far, the NRA has not released a statement regarding the Sandy Hook Elementary School shooting. After Rep. Gabby Giffords was shot in Arizona last year, the NRA did release a statement: “Our thoughts and prayers are with the victims of this senseless tragedy, including Rep. Gabrielle Giffords, and their families during this  difficult time.” The NRA released a similar statement following the Aurora, Colo., movie theater shooting this year: “Our thoughts and prayers are with the victims, their families and the community. NRA will not have any further comment until all the facts are  known.”

Yahoo News reached out to the NRA for comment. Our messages were not immediately returned.

Gun Control is Evil Misspelled

If you’re the biblically minded sort, then the trouble began when a jealous Cain clubbed Abel to death, but if you’re evolutionarily minded, then it’s a “chicken and egg” question. Violence had no beginning, except perhaps in the Big Bang; it was always here, coded into the DNA.

The issue isn’t really guns. Guns are how we misspell evil. Guns are how we avoid talking about the ugly realities of human nature while building sandcastles on the shores of utopia.

The obsession with guns, rather than machetes, stone clubs, crossbows or that impressive weapon of mass death, the longbow (just ask anyone on the French side of the Battle of Agincourt) is really the obsession with human agency. It’s not about the fear of what one motivated maniac can do in a crowded place, but about the precariousness of social control that the killing sprees imply.

Mostly it’s about people who are sheltered from the realities of human nature trying to build a shelter big enough for everyone. A Gun Free Zone where everyone is a target and tries to live under the illusion that they aren’t. A society where everyone is drawing unicorns on colored notepaper while waiting under their desks for the bomb to fall.

After every shooting there are more zero tolerance policies in schools that crack down on everything from eight-year-olds making POW POW gestures with their fingers to honor students who bring pocket knives to school. And then another shooting happens and then another one and they wouldn’t happen if we just had more zero tolerance policies for everyone and everything.

Zero tolerance for the Second Amendment makes sense. If you ban all guns, except for those in the hands of the 708,000 police officers, the 1.5 million members of the armed forces, the countless numbers of security guards, including those who protect banks and armored cars, the bodyguards of celebrities who call for gun control, and any of the other people who need a gun to do their job, then you’re sure to stop all the shootings.

So long as none of those millions of people, or their tens of millions of kids, spouses, parents, grandchildren, girlfriends, boyfriends, roommates and anyone else who has access to them and their living spaces, carries out one of those shootings.

But this isn’t really about stopping shootings; it’s about controlling when they happen. It’s about making sure that everyone who has a gun is in some kind of chain of command. It’s about the belief that the problem isn’t evil, but individual agency, that if we make sure that everyone who has guns is following orders, then control will be asserted and the problem will stop. Or if it doesn’t stop, then at least there will be someone higher up in the chain of command to blame. Either way authority is sanctified, control or the illusion of it, maintained.

We’ll never know the full number of people who were killed by Fast and Furious. We’ll never know how many were killed by Obama’s regime change operation in Libya, with repercussions in Mali and Syria. But everyone involved in that was following orders. There was no individual agency, just agencies. No lone gunman who just decided to go up to a school and shoot kids. There were orders to run guns to Mexico and the cartel gunmen who killed people with those guns had orders to shoot. There was nothing random or unpredictable about it. Or as the Joker put it, “Nobody panics when things go according to plan. Even if the plan is horrifying.”
Gun control is the assertion that the problem is not the guns; it’s the lack of a controlling authority for all those guns. It’s the individual. A few million people with little sleep, taut nerves and PTSD are not a problem so long as there is someone to give them orders. A hundred million people with guns and no orders is a major problem. Historically though it’s the millions of people with guns who follow orders who have been more of a problem than millions of people with guns who do not.
Moral agency is individual. You can’t outsource it to a government and you wouldn’t want to. The bundle of impulses, the codes of character, the concepts of right and wrong, take place at the level of the individual. Organizations do not sanctify this process. They do not lift it above its fallacies, nor do they even do a very good job of keeping sociopaths and murderers from rising high enough to give orders. Organizations are the biggest guns of all, and some men and women who make Lanza look like a man of modestly murderous ambitions have had their fingers on their triggers and still do.

Gun control will not really control guns, but it will give the illusion of controlling people, and even when it fails those in authority will be able to say that they did everything that they could short of giving people the ability to defend themselves.

We live under the rule of organizers, community and otherwise, whose great faith is that the power to control men and their environment will allow them to shape their perfect state into being, and the violent acts of lone madmen are a reminder that such control is fleeting, that utopia has its tigers, and that attempting to control a problem often makes it worse by removing the natural human crowdsourced responses that would otherwise come into play.

The clamor for gun control is the cry of sheltered utopians believing that evil is a substance as finite as guns, and that getting rid of one will also get rid of the other. But evil isn’t finite and guns are as finite as drugs or moonshine whiskey, which is to say that they are as finite as the human interest in having them is. And unlike whiskey or heroin, the only way to stop a man with a gun is with a gun.

People do kill people and the only way to stop people from killing people is by killing them first. To a utopian this is a moral paradox that invalidates everything, but to everyone else, it’s just life in a world where evil is a reality, not just a word.

An armed society spends more time stopping evil than contemplating it. It is the disarmed society that is always contemplating it as a thing beyond its control. Helpless people must find something to think about while waiting for their lords to do something about the killing. Instead of doing something about it themselves, they blame the agency of the killer in being free to kill, rather than their own lack of agency for being unable to stop him.
